Allgemeine Kaufbedingungen

ReWinner provides a market platform for listing goods for purchase. The company is referred to as ReWinner and the Market Platform offered by ReWinner as ReWinner-MP. ReWinner has set the following terms of use and conditions for use and interaction with itself and on the ReWinner-MP (www.rewinner.ch). Any issue or dispute arising out of or in connection with these presented terms and conditions shall be exclusively referred to the courts competent for the City of Zurich, Switzerland. In the following, persons/companies wishing to or purchasing goods are referred to as or potential buyers or buyers respectively. Those posting the goods are referred to as Suppliers (and can in some cases be considered the seller if transfer of ownership occurs without ReWinner as an intermediary). Suppliers may contract ReWinner to sell goods on their behalf. Any specific terms for individual items listed on ReWinner-MP will be described for each item as “supplier specific purchase terms”.

Ownership of items listed on ReWinner-MP and Sales Process

The ownership of goods at the time of listing is either in the hands of the Supplier directly or those Suppliers contracting ReWinner to sell the goods on their behalf on the ReWinner-MP. Potential buyers can make a non-binding inquiry via the ReWinner-MP. ReWinner will send the potential buyer an offer which may include specific terms such as non-refundable down-payment manually by e-mail, fax or post which the potential buyer can accept by e-mail, fax or post. If the offer is accepted, the sale is binding and the potential buyer becomes a buyer. Ownership is only transferred to the buyer when 100% payment is received and the goods are transported away from the premisis. Should the buyer neglect to pick-up and tranport their goods even after paying in full, they forfeit the amount of money already transferred to ReWinner and/or the supplier.

Specific terms for a sale such as a non-refundable down-payment

In the case of specific terms such a non-refundable down-payment, if the buyer does not pick up the items within a period specified and mutually agreed upon between the buyer and ReWinner and/or the supplier, the buyer forfeits the opportunity to receive the goods. Additionally whatever down-payment has been made to ReWinner, to the supplier or a combination of ReWinner and the supplier remains with ReWinner as compensation for their time and effort even in the case that the items ownership is not transferred to the buyer.

Item Descriptions and Pictures on ReWinner-MP

Item descriptions and pictures are intended to provide potential buyers with information for determining asset value. While the information on each item is deemed to be accurate and include all relevant information affecting the value of the item, potential buyers should not rely on the item descriptions and pictures as their sole means for determining an item's value. Physically inspecting an item is the best way for a potential buyer to determine its value. In most cases, potential buyers have the opportunity to schedule an appointment with ReWinner and/or the supplier to inspect the goods physically on location.

Items are sold "AS IS WHERE IS"

Items sold on the ReWinner-MP by ReWinner or a supplier do not have warranties, express or implied. Illustrations, pictures, files or videos posted on the ReWinner-MP are for informational purposes only. Potential buyers and buyers have sole responsibility for determining an item's value. Buyers must conduct whatever due diligence is necessary for them to assess value prior to purchasing. By placing an order, the buyer waives any and all claims against ReWinner or the supplier based on the condition or value of items.

Transfer of Ownership and Risk of Loss

At the time of purchase (approving an offer), the buyer pays his invoice in full or part, whichever is agreed upon in the offer. Ownership of the item and risk of loss passes immediately to the buyer when full payment is received and the removal date occurs. If a winning buyer pays his invoice in full or part, but does not take possession of the assets during the agreed upon removal day, ownership and risk of loss will still transfer to the buyer.
